Only Once TUPE Information Confirmed

The discussion topic 'TUPE First Contact' has become quite large and full of discussions about when TUPE does and doesn't apply. It is therefore difficult to identify if anyone has actually been TUPED.

I have created this discussion as a place where members can let each other know IF THEY HAVE BEEN TUPED. Therefore once you have been TUPED or received contact from the new provider CONFIRMING you are being TUPED can you post a reply listing the region you are in, the provision you were on prior to TUPE and who you are TUPEing to.

This will be helpul to those waiting to hear about their own futures.

PLEASE CAN WE LIMIT POSTS TO THOSE ITEMS SUGGESTED ABOVE

Our organisation has been advised of all the Primes that we are transfering to but not all of the subcontractors it appears that not all of the contracts have been signed. We have all been advised through our organisation that all of the Primes will be taking measures. All of them have indicated one of the "measures" will be redundancies one prime has stated the amount and the other two have said that it is a measure they will take but given no indication of the numbers.
It has been suggested that we will all have to apply for the jobs. The transfer date has been indicated as the 20th June but as yet this is not set in stone.

I work in the Black Country, on FND, where the outgoing Primes are A4E and Future Skills Dudley. Everyone within my organisation has been given a TUPE transfer date of 20.06.11. Of the incoming WP Primes (FourStar, PPDG and NCG) both FourStar and PPDG have now started redundancy consultation with all incoming TUPE transfers. Of course, this is to be expected and is nothing to worry about for experienced, competent staff who should find themselves in new positions, with the new Primes, once the consultation period is over.

Tupe has been delayed from the 1st June to 13th June for working links to a4e in leicestereshire!!!!

I am an employee currently working on FND and have been informed that two subbies of G4S we were meant to be transfering to are not accepting TUPE (local council and another small provider). The majority of other staff in our area are going to alternative subbies via TUPE - is anyone else facing this and if so any advice on how to fight this? Concerned that a small group of staff (approx 30) are now facing a costly legal battle, the prospect of redundancy from our existing company come the end of Aug (FND) and a bleak future? Anyone know a good employment lawyer in Yorks & Humber?

I really wish someone would help those of us that have been in the firing line in the provision that JCP used before their customers went on to FND. I.e. those not involved with the WP
In the main the SFA Employability Skills Programme (ESP) was used for JCP customers, prior to the 6 month marker, who needed basic skills or ESOL training. Like everything else this programme ceased in April and has not been continued, it has now been consumed by new SFA ESF programmes for the unemployed ( PFU) or has slipped back into colleges, working in conjunction with their local JCP offices, to deliver intense basic skills and ESOL, now to be funded through the SAB.
As a private provider we don’t have access to the SAB and so we are locked out of delivering this provision to JCP and colleges are locked in.
We have just made 68 staff redundant and we can’t tell them exactly where their jobs went. Naturally colleges don’t want to take on board the TUPE liabilities that we believe may very well exist and as time goes by the problem just fizzles away. This seems to be the general rule with TUPE, those in the know have a saying ......delay delay and delay and the problem goes away. I wondered if anyone out there has successfully been ‘tuped’ from the SFA ESP to anywhere???

Ken is deffinatly at the hull uni. I recieved the information from a goverment minister. I was also told that the clac take on legal aid but they are not great from previous experience. There is one solicitors firm that hold a 1 hour surgery on employment law i for got the name but they are based on priory park near hessle. And there is only a couple up their. Apart from that you need to be put through to the law centre at the uni and ask for kens surgeries they will either redirect you to him or another solicitors. If you intend to pay the cost will be in the total of 4k for a group of you it can be split. I do not usually give my contact details out but if you really want to take the case into legal tribuneral then ill give you my e.maul address.

I have had my consultation today and been advised that I'll be transferring on either the 15th June or 1st September assuming my company can release me/do without me.

Definitely be some form of assessment as they may be over subscribed in certain departments/roles

Just left current compnies head office. Tomorrow I got a face to face with prime. Then induction the rest of the week with new prime and start delivering WP from monday.

Currently working on New Deal (for today anyway) in cheshire being TUPED to Avanta. But have been warned that redundancy is still a real possibility.

Does anyone have any news regarding the start of the work programme in Manchester that was going to start today?

Having had an initial consultation with the Prime I'm to be TUPE'd to they have said it starts as of next week in the North West I'll be starting with them either next week or September

I am in the situation that I am supposed to TUPE out to start on the work programme next week. No consultation, no idea as to who (if anyone) is taking us on and even if they do, the prospect of being made redundant immediately anyway.

Time to get out of the Welfare to work game I think.

There is no money in it for the sub contractors as the primes are not filtering it down and worst of all the people that we are here to help suffer the most due to the subs trying to operate with as few a staff as possible.

There will be many subs give contracts back when they realise they won't make any money!
I know of one near me who has given up before it's even started.
The whole industry is in a total mess and it won't get better for ages I'm thinking.

I got into W2W after being turned down by JHP and TNG and have done alomost 18 months and find it really rewarding. Assuming Iget to keep my job I'm in it for the long haul

In the north east have just had confirmation of the prime that I am going to but have yet to receive a date. Have been asked by prime to suggest a date from 13th June onwards....
