TUPE

TUPE transfer

Hi, I would like to ask a question about TUPE transfer.
As employees, we were told that our company will send information such as our name,job title and salary to the new providers (ie:main providers of the CPA)
Can someone confirm if this is actually true?
If there are 3 or more providers, does it mean that each provider chose the employees they wanted based on the information given to them? Or was it up to the company transferring the employees to "dispatch" staff to main providers?

TUPE Work Programme

Can anyone answer this scenario...........if someone was TUPE'd from an FND provider to a Work Programme sub-contractor, and then the sub-contractor loses the contract due to performance failure, would the TUPE staff be TUPE'd again to the next provider or made redundant??

TUPE staff take our jobs

Hi all

I currently work for the CTF programme in the Yorkshire and Humber region. I am on a permanent contract and have been served my 90 day consultancy, I work for a prime that has won WP and has TUPE'd across in excess of 50 staff from other W2W providers, my company are making me redundant and they are giving the jobs to the TUPE staff first instead of the existing staff. Is this legal?

Opposite of TUPE problem

I work for a winning prime in the south I have been working on the ESF provision. So would't be eligable for TUPE on to the Work Programme.

If my company have to TUPE in FND staff from other providers. Does that mean that I have lost my job.

We have been told to expect redundancies. But surely in a head to head I should keep my job because I was here first.

Some colleagues are saying the TUPE staff will take preferance because they are TUPEable and we aren't.

Positive experience of the Work Programme -

Let's balance things and hear from those who have had a good experience of the Work Programme, such as retaining their job, getting a better job, smooth tupe experience etc. If you want to slag the WP off there are plenty of other topics for you, please keep this on topic for a balanced view.

TUPE OR NOT TUPE

I am currently working on FRW and have been informed that I am not covered under tupe. Am I wrong or do we all do the same job (FND,FRW,ND etc) we provide a service that assists people in to work. Our employers are playing games with careers here, they were happy to employ us in these role but are now happy to of-load when the going gets hard. I to, have worked very hard on FND,ND etc, so why am I not covered???

GETTING TUPE'D TO G4S OR ONE OF THEIR SUBBIES!

Are you being TUPE'd to one of G4S's subbys for the Work Programme? Our team are in Yorkshire and Humberside and are being refused TUPE rights from FND to Work Programme and would like to know details of who you are being TUPE'd to and if this is end to end provision (they are doing all or part of the delivery). We are trying to make contact with anyone who is being refused TUPE for whatever reason directly from FND or indeed has been included on a TUPE list to one of G4S's subbys who are not delivering end to end provision. Any help would be greatly appreciated. Thank you

FND staff who are not deemed TUPE eligible to WP

Are you currently working on FND but have been told you are not TUPE eligible to Work Programme, either by your current employer or the Prime/their subbies?

Do you feel you are being left behind and feel let down?

Have you been told why TUPE does not apply from FND to WP in your area? Is it due to fragmented provision (not end to end) or another reason?

Uncertainty in the North East

I work for one of the companies that won the bid to deliver in tees valley in the north east and have been kept relatively well informed by our hr about changes that will be made but rumours have just been confirmed that because tupe applies to the companies that lost their bids, that our jobs are now unsafe too. We currently have a team of around 65 advisors and the allocation (and cost cutting too) means we will only need a maximum of about 80 advisors.

NDDP/Pathways to Work Staff

Just wondering how many pathways to work staff have already been made redundant, the provider I work for claims that TUPE should apply for NDDP/Pathways, although the forum gives little hope that this is the case. Have any Pathways staff that are still in consultation heard anything about the issue?

Only Once TUPE Information Confirmed

The discussion topic 'TUPE First Contact' has become quite large and full of discussions about when TUPE does and doesn't apply. It is therefore difficult to identify if anyone has actually been TUPED.

I have created this discussion as a place where members can let each other know IF THEY HAVE BEEN TUPED. Therefore once you have been TUPED or received contact from the new provider CONFIRMING you are being TUPED can you post a reply listing the region you are in, the provision you were on prior to TUPE and who you are TUPEing to.

Pathways covered by TUPE?

I am a consultant working on the Pathways contract which is due to finish on the 27th April 2011 and have been told that we are not going to be covered by TUPE does anyone have anymore information on this? We have been told that we will be being made redundant
